The U.S. Department of Labor (DOL) recently refined its Public Disclosure System (PDS) which is available to the public to check the status of Permanent Labor Certification cases that are pending at the Backlog Elimination Centers (BECs). The DOL has also issued specific guidance regarding how to contact the BECs regarding the status shown on the PDS, and we also have some advice of our own based on the processing of cases for our own clients.
The PDS now includes the type of case, either Reduction in Recruitment, with “RIR” designation, or traditionally filed applications which require DOL supervised recruitment, with “TR” designation on the PDS. If employers or their agents/Attorneys believe the case type shown on the PDS is incorrect, then a communication should be sent to the specific BEC that is processing the application. . The subject line of the e-mail communication must read "Incorrect Case Type - Case # [insert case number]." The employer/agent/Attorney should also include the name of the Petitioner, Beneficiary, date filed, the reason she/he believes the case type shown on the PDS is incorrect and also include all supporting documentation. The supporting documentation may be attached to the e-mail communication as a PDF document. We would also recommend the same type of e-mail communication to the BEC in the case that a case is incorrectly closed but where the employer/agent/Attorney have not received a “Case Closure” letter from the DOL. e-mail addresses are solely for contacting the BECs regarding incorrect status shown on PDS, status checks or other case inquiries and/or issues where the employer/attorney/Agent have not received a letter from the DOL informing of the case closure. The DOL’s e-mail address:

is to be used for communications for cases where the employer/agent/Attorney has received a “Case Closure” letter about the case. According to the DOL, the BECs will review the case and reply as soon as possible based on the volume of requests. Depending on the volume of inquiries received, it may take the DOL a few weeks before the case type is corrected in the PDS. Reminder: If the area of intended employment is located in: Alabama, Connecticut, Delaware, Florida, Georgia, Kentucky, Maine, Maryland, Massachusetts, Mississippi, New Hampshire, New Jersey, New York, North Carolina, Pennsylvania, Puerto Rico, Rhode Island, South Carolina, Tennessee, Vermont, Virgin Island, Virginia, Washington D.C., or West Virginia then the employer/agent/Attorney should direct her/his communications to the Philadelphia Processing Center. If f the area of intended employment is located in: Alaska, Arizona, Arkansas, California, Colorado, Guam, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Louisiana. Michigan.
